Terms and Conditions

PREAMBLE

These General Terms and Conditions (hereinafter “Terms and Conditions”) apply between Marie Held, MSc, a psychotherapist in training under supervision (hereinafter “Psychotherapist”), and all natural persons (hereinafter “Clients”) who utilize the Psychotherapist’s psychotherapeutic services.

The psychotherapist enters into contracts exclusively on the basis of these Terms and Conditions and the relevant provisions of the Psychotherapy Act of 2024. By scheduling an appointment, clients give their express consent to the applicability of these Terms and Conditions.

The version of the General Terms and Conditions current at the time the contract is concluded—which is available on the psychotherapist’s website—applies to all clients.

1. SUBJECT MATTER OF THE AGREEMENT

1.1. The psychotherapeutic treatment agreement between the Psychotherapist and the Client(s) constitutes a contract for services (freier Dienstvertrag) within the meaning of Section 1151 of the Austrian Civil Code (Allgemeines Bürgerliches Gesetzbuch – ABGB). In particular, the Psychotherapist does not guarantee or owe any specific therapeutic outcome or recovery. The Psychotherapist shall practise the profession without discrimination, to the best of her knowledge and conscience, in accordance with the latest scientific knowledge, the applicable legal framework, and the relevant Code of Ethics and Professional Conduct.

1.2. The subject matter of this agreement is the support and guidance of the Client(s) through psychotherapeutic sessions.

2. SESSIONS

2.1. Psychotherapeutic services shall be agreed upon with the Client(s) on a per-session basis and invoiced accordingly. The initial consultation shall also constitute one psychotherapeutic session.

2.2. One psychotherapeutic session lasts 50 minutes. The fee for each session is EUR 80.00 (hereinafter referred to as the “Fee”). The Fee shall be paid to the Psychotherapist in cash immediately upon completion of the session. Subject to the Psychotherapist’s express consent, the Fee may alternatively be transferred to a domestic bank account designated by the Psychotherapist. The Psychotherapist shall issue an invoice to the Client(s) after each psychotherapeutic session.

2.3. Scheduled psychotherapeutic sessions are binding.

2.4. Any cancellation or rescheduling of a psychotherapeutic session must be communicated to the Psychotherapist in writing and must be received no later than 48 hours prior to the scheduled start of the session.

2.5. If a cancellation or rescheduling is made less than 48 hours before the scheduled session, the full Fee for the missed session shall be charged.

3. REIMBURSEMENT OF COSTS

3.1. The Psychotherapist is undergoing professional training under supervision ("in training under supervision"). Therefore, no partial reimbursement of the Fee is available through the Austrian public health insurance system or any other Austrian insurance provider.

4. PROFESSIONAL OBLIGATIONS

4.1. The Psychotherapist shall provide all psychotherapeutic services in compliance with the applicable statutory and professional regulations, in particular the provisions of the Austrian Psychotherapy Act 2024, the applicable Code of Ethics and Professional Conduct, and all other legal provisions governing the practice of psychotherapy.

4.2. The statutory and professional obligations of the Psychotherapist form an integral part of the treatment agreement concluded with the Client(s) and define the applicable standard of care in the provision of psychotherapeutic services.

4.3. The statutory professional obligations shall apply irrespective of whether they are expressly and comprehensively set out in these General Terms and Conditions. Mandatory statutory and professional provisions shall prevail over any conflicting provisions contained herein.

5. CONFIDENTIALITY

5.1. The Psychotherapist is bound by professional confidentiality with regard to all information and confidential matters entrusted to or otherwise becoming known to the Psychotherapist in the course of professional practice or the provision of psychotherapeutic services.

5.2. All conversations and the contents of psychotherapeutic sessions shall remain strictly confidential. The duty of confidentiality may only be waived with the Client’s express written consent or where required by law.

6. LIABILITY

6.1. Psychotherapeutic services constitute an individual therapeutic process that depends substantially on the Client’s personal circumstances, and the outcome is influenced by various additional factors.

6.2. The subject of the treatment agreement is the professional provision of the agreed psychotherapeutic services. No specific therapeutic outcome, including recovery, improvement, or the achievement of a particular personal or health-related treatment objective, is guaranteed or owed.

6.3. Furthermore, the Psychotherapist shall not be liable for any damage arising from decisions or actions taken by the Client on the basis of the therapeutic discussions.

7. DATA PROTECTION

7.1. Personal data shall be processed exclusively in accordance with the applicable provisions of the Austrian Psychotherapy Act 2024 and only to the extent necessary for the provision of psychotherapeutic services.

7.2. The Psychotherapist shall comply with all applicable provisions of the General Data Protection Regulation (GDPR) and shall treat the Client’s personal data as strictly confidential.

7.3. Personal data shall only be disclosed to third parties with the Client’s consent or where disclosure is required by law.

8. FINAL PROVISIONS

8.1. The treatment agreement between the Psychotherapist and the Client(s), as well as these General Terms and Conditions, shall be governed exclusively by Austrian law.

8.2. Should any provision of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to its intended economic purpose.

8.3. The court having subject-matter and territorial jurisdiction at the registered office of the Psychotherapist in the 1st District of Vienna shall have exclusive jurisdiction.
